This website and all associated pages and interactive tools (collectively, the ‘Website’) are operated by Morningstar Investment Management Australia Limited (ABN 54 071 808 501, AFS Licence 22896) (‘Morningstar’, ‘we’ or ‘us’). Your access to the Website is subject to these terms and conditions, the Morningstar Privacy Policy, and any other terms and conditions, notices or other statements contained herein (referred to collectively as ‘Terms and Conditions’). By using the Website, you agree to be subject to the Terms and Conditions and to abide by them.

Licence

Subject to the terms hereof, Morningstar grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Website for your (and/or your family’s) personal, non-commercial use. No other rights or licences are granted to you under these Terms and Conditions.

Purpose of Information

The Website has been prepared to provide you with general information only, may be accessed by you solely for your (and/or your family’s) personal, non-commercial use and remains the property of Morningstar, its affiliates and/or their licensors, as applicable. The Website should be viewed as an additional investment resource, not as your sole source of information. To the extent any information provided is advice, it is general advice only. In preparing this information, we have not taken into account your individual objectives, financial needs or circumstances. Morningstar recommends that you obtain professional financial and taxation advice specific to your investment objectives, financial situation and particular needs before making an investment decision. In addition:

  • you should be aware that past performance does not necessarily indicate a financial product’s likely future performance; and

Wealth Forecasting Engine

As part of the Website, we provide you with access to the Morningstar® Wealth Forecasting Engine (“WFE”), a simulation tool which prepares forecasts of projected investment balances and potential returns available to investors. The WFE is designed to provide a forecast only and does not predict actual results. The projected balance and any other results generated by the WFE are only estimates, so the actual amounts may be higher or lower. WFE forecast is general information only and does not consider your personal circumstances. Please refer to the detailed Assumptions for more information about how the forecasts are calculated.

Applications to Invest in Morningstar Next

Morningstar Next is available via the Website are offered through a Separately Managed Account Managed Investment Scheme (ARSN 114 818 530). Praemium Australia Limited is the Responsible Entity and issuer of the Product Disclosure Statement. Applications to invest in Morningstar Next may only be accessed through this Website.

Each investment strategy is referred to as a Model Portfolio. Morningstar is the Model Portfolio provider in Morningstar Next. Please see the Investment Menu for more information.

Tax File Number

We are permitted to request your Tax File Number under the Tax Administration Act 1953.

You don’t need to give us your Tax File Number. If you choose not to, we must withhold tax from your distributions (For example ), at the highest marginal rate plus Medicare Levy.

It is not an offence if you choose not to quote your Tax File Number.

You may also give us your Australian Business Number, if acting on behalf of a business, or a TFN exemption code. To find out if you qualify for an exemption code, please see the Australian Taxation Office’s website.

We only provide your Tax File Number to the Responsible Entity, Praemium Australia Limited, who may give it to investment bodies or share registries for the purpose of paying distributions or maintaining their registry. They may also give it to the Tax Commissioner when submitting an Annual Investment Income Report (AIIR), as required by legislation. We do not provide your Tax File Number to any other entity or organisation.

If you have chosen not to give us your Tax File Number, and later change your mind, please give us a call and we can update your records. , so if you’re not sure you’ve given us the right one, or wish to register an exemption code, simply provide the correct one again, and we’ll readily update it.

Currency and Accuracy of Information

The information contained herein has been obtained from sources that we believe to be reliable, but neither its accuracy, nor its completeness nor its timeliness is guaranteed. We make commercially reasonable efforts to update information on the Website as soon as practicable to do so.

Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Morningstar will not be liable in any way for any loss, damage, liability or expense of any nature (including but not limited to legal costs and defence or settlement costs) suffered by you through or otherwise arising out of use of or access to the Website, or Morningstar’s failure to provide the Website. Our liability for negligence, breach of contract or contravention of any law as a result of our failure to provide the Website or any part of it, or for any problems with the Website, which cannot be lawfully excluded, is limited, at our option and to the maximum extent permitted by law, to resupplying the Website or any part of it to you, or to paying for the resupply of the Website or any part of it to you.

Without limiting the above, Morningstar disclaims all liability for any loss, damage, liability or expense you may suffer as a result of or arising from:

  1. Your reliance on any Product Disclosure Statement; or
  2. Any Application to invest in Morningstar Next.

To the extent Morningstar cannot exclude itself from liability hereunder, Morningstar’s maximum liability to you will be limited to the lesser of: (1) the maximum to which you are entitled under applicable law; and (2) the amount, if any, which Morningstar has received from you, and which has not already been rebated to you.

General Conditions

These Terms and Conditions are governed by the law in force in the State of New South Wales, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and courts of appeal from them for determining any dispute concerning the Terms and Conditions. These Terms and Conditions can be modified at any time by Morningstar and, if you continue to use the Website after such modification, you agree that you are bound by these Terms and Conditions as modified. We will provide notice of these changes by publishing revised Terms and Conditions on the Website; we will not separately notify you of these changes. If the whole or any part of a provision of these Terms and Conditions is or becomes void, unenforceable or illegal in a jurisdiction, it is severed for that jurisdiction. The remainder of the Terms and Conditions have full force and effect and the validity or enforceability of the particular provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of the Terms and Conditions or is contrary to public policy.

Termination

We may terminate your access to all or a portion of the Website at any time without notice and without liability. All disclaimers and limitations of liability apply to Morningstar, its affiliates and their content providers and remain in effect in perpetuity.

The Morningstar logo, and other related logos are trademarks of Morningstar, Inc. You may only use the Morningstar trademarks with the express permission of Morningstar.

Subject to the Terms and Conditions, you may not:

  1. systematically copy (whether by printing off onto paper, storing on disk or in any other way) substantial parts of the Website or otherwise use any material contained on the Website except as set out in these terms and conditions;
  2. remove, change or obscure in any way anything on the Website;
  3. reproduce, retransmit, disseminate, sell, publish, or broadcast any material contained on the Website, or use anything available from the Website in connection with creating, promoting, trading, or marketing investment products without the express written consent of Morningstar; or
  4. use any material from the Website for unlawful purposes.

Any materials downloaded in breach of these conditions remain the property of Morningstar, and you agree to provide all and any necessary information to allow Morningstar to recover its property.
